Retirement planning covers many specific areas of Elder Law and Estate Planning. The following is designed to give general information with specifics required at an initial intake with an attorney.

In considering a persons various retirement options, the following should be reviewed:

Whether or not to elect lump sum distributions, rollovers or other distributions from the client’s qualified retirement plan(s);
Whether any such distributions should be rolled over into an IRA;
Who should be the beneficiary of the Qualified Plan and/or IRA;
How should the benefits be paid out; and/or
Whether the client’s spouse should disclaim any benefits coming form the Qualified Plan and/or from the IRA.

In addition to the consideration of the above, Estate Planning, Elder Law and Wills and Trusts should be reviewed for a complete determination of the best course of action for the client.
